    IEEE-USA has recently changed their site. Earlier their title was H1B visa. Now the title is Immigration Reform.

    IEEE has a huge number of Indian, Chinese and Korean members. I would not be surprsied if > 50% members are immigrants.

    I have not heard that Programmer's Guild/Lou Dobbs supports IEEE-USA or vice-versa. Please let me know if you have a reference.

    I was the first person in the QnA - disappointed at the intent of this meeting - they really care about illegal immigration - not once legal immigrants were discussed. It was a farce and IV was just used as an organization to show support to him - very disappointed.:mad:

    You are the biggest idiot on the face of the earth. You went to the event saying that you represent Immigration Voice. Then you started showing your elitist attitude during your question. If I recollect, your question was:

    You came to US on student visa, changed to H1 and filed for green card. You do not want to live in US but simply want to go back to India after getting a “higher degree”. Since you have declared your immigrant intent, you are not able to change to F1 visa. Stanford and Berkeley Universities are dying to have you as a student in those Univ. What should you do …..

    How the hell do you expect a Congressman to answer a question that is meant for an immigration counselor/attorney? To begin with, why did you even ask such a question in this event? Do you have any idea what Immigration Voice is about? When you are saying you want to go back, why don’t you simply leave? Why the hell is there a need for you to come to a meeting and ask a question that does not represent the problems of the majority and the representative sample of IV members? It would be one thing if your question represented the problem in general. But it is entirely different thing when you come to such event and want to get answers for your question so that you don’t have to pay $100 to an immigration attorney. I truly feel ashamed of being called as “highly skilled” immigrant when elitist like you ask such stupid question. There is definitely something wrong with the selection process of Berkeley and Stanford to select idiots like you. Sometimes, looking at some posts and people like yourself, I personally feel that people whom you called “illegal immigrants” are far better than people like you. And without having any clue of the bigger objective of the meeting and our participation, you are coming here and posting that you are “disappointed at the intent of this meeting”. Boy! you have some nerve. Best of luck with your tunnel vision which is sure to take you places.

    On a different note, Congressman Gutierrez is a true leader. He took the lead in sponsoring COMPREHENSIVE IMMIGRATION REFORM bill. Congress is full of people who do not look at the merit of the issue but simple look at the polls to decide their stand on the issue. Congressman Gutierrez showed exceptional courage and quality of a true leader by sponsoring STRIVE bill. If you don’t know, STRIVE bill has very good provisions to end green card backlog. But of’course, why would you care, you are simply dying to go back and simply wanted to show to the crowed that you are better than others. You have no clue about “COMPREHENSIVE IMMIGRATION REFORM bill”, would you? I would have not replied to you if you hadn't posted your message. But seeing you behave the way you did at the event, and then coming to the forums to say that you were “disappointed” underscores a simple fact, and that is, when IV has foolish members like yourself, there is no need for anti-immigrant groups to do anything.

    there is still the last quarter's quota
    which is 100 - (27% X 3) = 19%

    this 19% cannot be issued in July either- not more than 10% a mnth

    there is no question they ignored this
    i'm curious to know what reason they will use to justify it.
    especially if it's a deposition under oath.

    I have worked in France and Belgium for a little over an year and this is my personal experience - the work environment at that time 2000 - 01 was alright. However, I had to struggle with language barriers and worse of all - the keyboard barriers. The standards in IT industry were very very different and though it was an experience, the learning curve was huge. Personally, I would much rather prefer to be in US or better still in UAE I'd think.

    Next, I have been reading a lot about reverse brain drain - where families were going back home. I also heard about some site about return2India.com. And my brother took the step after pondering over it for an year - he had it all - GC, a family here, job at you know where in Seattle - and his experience has been an enlightment - he is now struggling with work life ratio - he spends most of the day/night at work and he has to pay bills at the bank and he has no clue what is going on at the school and somehow, his team in India thinks he is a smartass because he tries to apply certain standards (which ofcourse is normal here) and he speaks with an accent. And yes, if you studied here and lived for 10 years, you too will have the accent. But, he says he is very satisfied and happy to be there.And then he says, the pay scale is sufficient for him and his family to lead the Indian dream. We should have some way of commuicating with such expatriates too!!!

    Thanks for sharing your brothers experience with us. My sister and Brother in law also took a similar decision about 2 years back and yes they were quite frustrated too, my brother in law even started looking for options to come back to US, for some reason he never returned .

    Now they are pretty comfortable, they feel that it takes a while to get adjusted to India again but once they got used to living life the India way they just loved it...now they keep trying convince me to go back ;)

    Yes, you are right that we cannot sue anyone for working harder. I agree with that part too.

    I didnt say they broke the "law" by processing several thousands of cases. What they did is broke their own "regulations" by approving applications with incomplete security/back ground checks.....In the current environment the country is in, this could be a very serious issue. Well again they can argue that regulations can be moulded/twisted to their liking.....

    From Oct 2006 - June 2007 USCIS only used 80k of 140k immigrant numbers available and by the end of June, they consumed all of the 140k quota.....There were cases where 485s were approved on 2nd and 3rd of July.....They made a complete mockery of their own regulations is alloting visa numbers as they like....

    Please allow me to being a glaring error in the concerned article. The rally organized by highly skilled legal immigrants in Washington D.C. on the 18th of September 2007 was not for increase in H1B visa numbers. The high skilled immigrant community was protesting against unfair backlogs in the employment based immigration categories. Currently applicants in some categories are facing a wait time of about 8-10 years if they are from a certain country. Applicants with higher degrees (Masters and Doctorate) from US universities are also a part of this backlog. Always illegal immigration overshadows legal immigration on any forum in the immigartion debate and this group of protesters were trying to bring the hihg skilled legal immigration issue into limelight . When countries like Australia,England,New Zealand, Canada and even Ireland are making high skilled immigration easier, the US has not updated its immigration laws in the high skilled sector for the past 20 years. Also with the booming economies of China and India needing more highly skilled workers the competition for talent is hotting up by the day.
    CNN being a responsible and influential media house should highlight the issue of high skilled immigration and not skew the facts.

    Hi, do you know how long it took them to clear name check? which EB category /country are you? Mine is stuck in name check and am trying to find some pattern and if possible, some solace.. thanks.

    Your case is unique. Either it will get through quickly or it won't.

    BROADLY SPEAKING, 90% of cases take 6 months of less to get through name check. Some take longer. Depending on how common your name and it's variatiosn are, and depending on whether or not there are hits in the FBIs database, that will determine how it goes for you. Some are through in 2 weeks. Some in 2 years.

    Sadly, it's not predictable in any way.

    As per IV core we should be doing lobbing and lobbing needs money. We had tried few times and the latest High Five had not collected enough money that can be used for lobbying. How can we count on our members to do something big.
    I think we should work in our state level chapters, collect funds for activites and when we have a solid foundation talk about activities like flower campaign, rally etc.. where everybody would be involved.

    has metro access. Baltimore has MARC but it won't be that frequent and cost effective.

    Which airport should members be looking to book the tickets to? Baltimore, Dulles or Reagan? Which is the closest to the Capitol Hill or which airport has the easy public transportation access to Capitol Hill. I would like to go ahead and buy the air tickets.

    Employment Visas 2009

    Total Employment Visas for FY2009 = 141,020

    Theoretical values without spillover

    EB1 28.6% = 40,332
    EB2 28.6% = 40,332
    EB3 28.6% = 40,332
    EB4 7.1% = 10,012
    EB5 7.1% = 10,012

    Actual values with spillover

    EB1 40,978 = 29.1% received c.650 spillup visa used
    EB2 46,034 = 32.6% received c.5,700 spillover visas used
    EB3 39,791 = 28.2% received c.550 less visas than quota
    EB4 9,999 = 7.1% Zero spillup visas to give
    EB5 4,218 = 3.0% c. 5,800 spillup visas to give

    What is noteworthy is the fact that spillup/spillover visas were only available from EB5.

    In addition, EB1 actually consumed spillup visas and did not contribute any spillover visas as a result.

    This implies that the total spillover visas available to the 7% limited countries was only c.7,500. Since 5,800 came from EB5, less 650 used by EB1, this gives a subtotal of 5,150. In turn, this implies that there were only 7,500 - 5,150 = 2,350 as spillover from EB2-ROW. In the worst case the difference is entirely from EB5.

    I think it gives food for thought and shows the difficulty of trying to second guess visa consumption in Categories that are always current. I accept it might be easier to get a handle on non-NIW EB2 because of the PERM data available for ROW.

    I'm not sure why FY2010 would be much different, at least for EB1 spillover.

    Additional notes from subsequent posts:


    There was significant spillover in FY2007 because (based on 154,497 total EB visas) :

    EB1 only used 26,806 out of a possible 44,186 available visas.
    EB4 only used 4,794 out of a possible 10,969 available visas.
    EB5 only used 793 out of a possible 10,969 available visas.

    That gives a potential spillover of 33,731 visas to categories below EB1. In FY2007 that mostly went vertically to EB3.

    There was significant spillover in FY2008 because (based on 162,949 total EB visas) :

    EB1 only used 36,590 out of a possible 46,603 available visas.
    EB4 only used 7,648 out of a possible 11,569 available visas.
    EB5 only used 1,443 out of a possible 11,569 available visas.

    That gives a potential spillover of 24,060 visas to categories below EB1. In FY2008 that all went to EB2.

    The amount *was* smaller in FY2009 because (based on 141,020 total EB visas)

    EB1 used 40,978 which was more than the available visas of 40,332 (i.e. it used some of the spillup from EB4/EB5).
    EB4 used 9,999 out of a possible 10,012 available visas. (i.e it pretty much maxed out)
    EB5 only used 4,218 out of a possible 10,012 available visas. (i.e. much higher than previous years)

    That gives a potential spillover to EB2 of 5,161 visas, which is substantially lower than previous years.

    This is all his analysis based entirely on historic data (no predictions here; just what has already happened). All credit of analysis goes to him. I never crunched a single number; I am just an "integrater" of the info. Please also note that now we have found out that the word "spillover" should actually be "fall across and down"

    Now,

    1. Why did EB1 last year needed spillover visas, although it was current all the time? If a category is current, isn't that it has less demand than allocated numbers?

    2. As per May bulletin, EB4 might need a cut off. So we cannot expect any spillover from EB4. So that is clear. Now the spillover chances are from EB5, EB2 ROW and EB1(?). I am including EB1 because, given the current economy over the past year, should there be a better possibility of more spillover from EB2 ROW and EB1 compared to last year?

    3. Also why are the total EB numbers different in different fiscal years (e.g., 141020 in FY2009, 162949 in FY 2008 and 154497 in FY2007)? In FYs 2007 and 2008 did the extra visas come from Family based while it did not for FY 2009? If so, why is it so?

    4. Based on Pending 485 data of March 2010, I barely see few hundred EB4s. And hardly considerable number of EB1s. What's going on? If we go by this data, we should be getting good chunk of spillover numbers...

    I had to reluctantly stay away from the rally due to a brand new baby at home, but I sure hope to be part of future efforts.

    And I totally agree that Legal is the keyword. Most Americans are not clear about Legals v Illegals and lump them together. Of course, some just do not care and do not see a need to differentiate between the two. They would just like to see Asian and South Asian folks get out of the country.

    And I also am not in favor of asking for an increase in GC quota. Instead I am in favor of not counting spouse and kids against the quota. This itself will effectively inrease the quota to over 350K per year. Directly asking for quota increase always leaves a bad taste for skeptics and will slow down any possible action.

    I am in a very Bad situation it seems, please help.

    I am working in US on L1B visa and Wife on L2. then Wife got a Job and her employer filled her 485.

    In the mean time I applied for H1 (through a consultant, to get out of the L1B company). Looks like the H1 Got Approved. Now, I think the problem is, If I switch to H1, then she will loose her job and our chance of Getting EAD will go.

    I do NOT want to go for H1, but EAD Is important to me. Is there a Way I can keep my L1? (so that my wife can keep her job)

    Please help

    Did you guys noticed there is no Explanation about EB cutoff dates in this VB as they used to put some comments about how the going forward will be..thats strange:mad:
