Congrats Retrohatao.
What's depressing about the process is that it takes so long for greencard that people dont even remember their priority date by the time they get greencards.
Retrohatao has posted PD of his first GC file as :"Sometime in 1998". Note the word sometime.
This word, "Sometime" shows the delay.
In America, glaciers move faster then the Greencard process.
That's the reason Universities are going to pay a dear price of all this when the next generation of potential students and research scholars dont come here.

Can anyone please comment on Massachusetts licensing requirements? and the validity period for someone who is working on EAD? Thanks!
Fortunately, MA is still unaffected by the xenophobic policies regarding Driver's Licenses that are prevalent in other states. You can renew your license online, and the length or the nature of the validity of your immigration status has no influence on the type or duration of the driver's license. How long this will stay like this in MA is anybody's guess. I am sure they will also become restrictive when pressure is brought on by REAL ID regulations.

My parents are scheduled to travel on Monday via delta flight to India via Paris. As you all know all European flights are either cancelled or postponed and paris airport is currently closed. Their I-94 date is 19-April.
They will travel on next available flight if we find that monday flight is cancelled (which is likely). Assuming that their travel is cancelled or postponed, it is evident that they will most likely pass their I94 date.
What should we do in such situation? Just trying to understand any steps we need to take in advance if we have to notify any authority etc.
Appreciate your help,
thanks!

I sent my supporting documents for e-filing to NSC PO box and it reached next day noon. I also got LUD next day.
This is what I see on the USPS Tracking details.
'"Your item was delivered at 11:03 AM on July 8, 2008 in LINCOLN, NE 68501 to INS EXPRESS . The item was signed for by F HEINAUER."
Hope this helps!
You are right - The status changed today saying some one has picked it up - So express mail is good for sending.
Does the checks getting cashed mean the applicaton is accepted - and for whatever reason if they deny willu get the fees back?????

Asian,
I know what you mean... there is nothing to stop us from doing something else totally different from our job description once we become permanent residents.
That's just how the immigration law works... and I think it applies to all nations in the world. You can't say that you want to work as a carpenter when you filed your GC as an IT skilled worker (as an example). Like as previously mentioned, it would make the LCA stage pretty obsolete.
But I think it would be GREAT if we were all allowed to freely change employers (within the same industry of work) without being shackled by employer sponsorship. I am sure that would please everybody, except for the bosses of course.

Hello I opened 2 SRs 4 weeks ago. Yesterday I got two notices from USCIS.
My wife got finger printing notice but my notice says that "USCIS will notify me of biometrics when the appointment is available". Its so weird. I'm the prime applicant. Anybody any ideas? My lawyer said wait for 1 month. I spoke to USCIS customer service and they said wait for next month and open another SR.
My case was filed at NSC , then went to CSC and then transferred to NSC.
Anybody any ideas? Have they heard of cases where dependants are getting FP while Primary is waiting.
I have heard many cases where in the dependant gets their EAD faster than the prime applicant. My guess would be that USCIS is prioritizing H4 to get the EAD faster since the prime applicant already has the H1. That does not mean you wont get your EAD ever but it looks like it is not a higher priority.

You need to be a credentailed teacher to get a H1B in most cases. For credentialing, you either need a B Ed from India or complete the teacher credentailing program in US. For the credentailing program, you will need to get your degree evaulated, pass the CSET exam or Praxis in some cases and finish the university requirement.
Pls PM me if you need more details.

The site appears to be latest. And here is the content
------------------------------------------------------
Who Can Apply in Mexico
* Applicants seeking to renew their C1/D, D, F, H, I, J, L, M, O, P and R visas, if the initial visa was issued in the applicant's home country or at one of the border posts in the past few years.
I guess, if your first visa was issued in the home country, you should be ok to renew before it expires
Notice: Certain visa applicants may be subject to additional administrative processing. This administrative processing may last weeks, thus delaying visa delivery and the applicant's return to the United States. Every effort will be made to expedite these procedures; however, it is not possible to guarantee completion of this process by a particular date.
PIMS !!!
------------------------------------------------------
Who Cannot Apply in Mexico:
* Applicants for B1/2 visas, including renewals are not accepted from third country nationals who are not resident in Mexico.
* Applicants who entered the U.S. with a visa issued in their home country and changed status with Department of Homeland Security in the U.S. who seek a new visa in the new visa category
I guess, this may be the visas expired, continuing on valid I-797 and trying to get new visa on the same category, I am not sure, difficult to interpret
* Applicants who entered the United States in one visa category and are seeking to re-enter the U.S. in a different visa category.
I guess, if you change from F to H, you may be in this category, I am not sure, difficult to interpret
* Applicants who have been out of status in the U.S. having violated the terms of their visas or having overstayed the validity indicated on their I-94s.
* Applicants who entered the U.S. under the auspices of the Visa Waiver Program.
* Applicants who obtained their current visa in a country other than that of their legal residence.
* PLEASE NOTE: If you were informed when you obtained the original visa in your home country that you are subject to National Security Entry Exit Registrations (NSEERs), are a national of North Korea, Cuba, Syria, Sudan or Iran, you are not eligible to renew your visa in Mexico.
*TCN Visa Renewals– Before deciding to apply at a consular section in Mexico, third country nationals should keep in mind that traveling to the country may require the appropriate Mexican visa from a Mexico’s embassy or consulate before making the trip. Potential applicants should be sure they have a visa, if necessary, and are prepared to wait several days in Mexico while their visa is being processed.

Per Murthy EAD will be ganted only for one year if I-140 has not yet approved.
An important point made in the clarification is that, regardless of an unavailable priority date, the EAD will only be granted for one year if the I-140 petition has not yet been approved.

Please don't dilute the admin fix effort by starting another letter campaign.
IV just finished a letter campaign in which one of the items were 3 yr EAD/AP. Why do we need another letter campaign? There is still lot of work going on related to the Admin fixes, please do work with your state chapters to setup meetings with lawmakers to seek their support for the Admin fix effort.

I had 1 year contract for employment and I was not paid regularly. Also they were deducting money for health insurance which I didnot receive.
So I left company and they didnot pay me money. I had one year contract or 10000 USD fine.
iI donot work for them since 2005. I have time sheet signed by client and email from vendor to confirm that they paid my money to employer.
Can i go to labor and complain ? Will they ask me to pay back 10k ?

DHS was looking for someone with deportation order of Walawala's place, which the person wasn't there, never lived there, never existed there. Walawala and his wife have valid H1 and H4 status. They looked at their document and with face that look cynical said that Walawala and his wife are 'ONLY' worker that come to this country and threathened they could have done something to harm their status.
